## What a 30-day notice to vacate in California should say

A notice to vacate needs six lines, and none of them are difficult. **A notice to vacate** is the short written statement telling your landlord which day you are returning the keys. Include these:

- Every name printed on the lease agreement.
- The unit address, written the way the lease itself writes it.
- One sentence saying the tenancy ends on a named date.
- A forwarding address, which is where the deposit and the closing statement get mailed. Leaving it off is the usual reason people wait months for their money.
- Your signature, together with the date you signed it.
- A sentence requesting the move-out walk-through, since asking early costs you nothing whatsoever.

Read your own lease before you write the date in. **A month-to-month tenancy** is a rental with no fixed end date that renews every rent period until one party gives notice, and 30 days is the ordinary figure there. A fixed-term lease behaves differently, because it usually expires on the date printed inside it. Some agreements also require the notice to arrive a particular way, and a lease specifying certified mail is not the place to improvise. ## Hand it over so you can prove you did

Hand the notice over in a way you can prove, because proof of delivery is the step people skip. It is also the step that gets argued about afterwards. **Proof of service** is the record showing when your notice went out and how it travelled. Three habits produce one. Hand the notice to the manager and ask them to sign and date your copy. Email identical wording the same afternoon as a backup timestamp, so a record exists somewhere neither party controls. Use certified mail whenever the office is a locked drop box with nobody ever behind it.

Then file that evidence with your lease agreement rather than in a text thread. A text message is easy to send and remarkably easy to lose, and it is a poor thing to be depending on six weeks later.

The 60-day number is what confuses people, and it usually belongs to the other party. It is generally the notice an owner gives a long-standing tenant, rather than an obligation a tenant carries. So if a 60-day notice arrives carrying your landlord's signature, that is their clock running rather than an instruction to remain for two months. Ask in writing whether an earlier departure suits them, and keep their answer in writing as well.

Count from the day after you deliver the notice, rather than from the day you wrote it. For example, hand a signed notice to your manager on Monday, October 26. October 27 becomes day one, and day 30 arrives on Wednesday, November 25. That Wednesday is when the keys are due.

So reserve the truck for November 23 or 24 instead. Two days of margin covers the difficulties that genuinely materialize. An elevator nobody reserved. A neighbor parked across the driveway at 8am. Cleaning that runs considerably longer than the version of it in your head.

Confirm the ending date with your landlord once you have counted it, and do that in writing too. A date the two of you agree on is worth more than a date only you calculated.
