# Landlord Not Returning Your Security Deposit in California: What to Do

A landlord not returning your security deposit in California is usually a paperwork problem, and most of what decides it happens on the day you hand the keys back. The state gives a landlord 21 days after you move out to send the money, or to send the balance with an itemized statement. We empty rental units across Los Angeles and Orange County every week. What follows is the mover's half of the job: the address, the evidence, and the timing.

Sealed and ready: tell us what moves

## At a glance

- California allows 21 days after you move out for the money or an itemized statement to reach you.
- The most useful thing you can do costs nothing: leave a forwarding address in writing before the keys change hands.
- Twenty minutes of photographs and one slow video, shot in an empty and well-lit unit, settle most disputes before they begin.
- Damage a crew causes belongs with the mover. Send us the photo the same day rather than raising it at the walk-through.
- When day 22 arrives with nothing, a dated letter comes before anything else. California's courts publish the steps and answer questions free.
- Book the truck for the morning. A load that finishes at 4pm takes the evidence pass down with it.

## Leave them a way to send the money

Most missing deposits are not being withheld. They are sitting in an envelope addressed to the apartment you just left, or waiting on an accounts clerk who has no idea where you went. **Your move-out date** is the day you hand the unit back, and it is not always the last date printed on the lease.

Four things go out before the keys do.

- Text and email your forwarding address to the landlord, and keep both sent messages.
- Ask who actually issues the check: the owner, or the management company named on the lease. Send the address to both.
- Start [USPS mail forwarding](https://www.usps.com/manage/forward.htm) before move week, and check its own page for how long it takes to begin working.
- Write down the deposit amount from your lease, along with the date you paid it.

**Mail forwarding** is the postal service redirecting your mail to a new address for a set period. Treat it as a safety net, not as a substitute for telling the landlord. It does not begin the instant you file it, so a check posted in your first week away can still land in the old mailbox.

## The last twenty minutes: photograph, then film, then back it up

Photograph the empty apartment, not the half-empty one. Furniture hides exactly the floor and wall a charge will later be written about, so this pass waits until the crew carries the last item out. Give it twenty minutes in a one-bedroom and around forty in a three-bedroom.

1. Open every blind and switch every light on. A dim phone photo proves nothing to anybody.
2. Shoot each room from the doorway, then move in on whatever could be argued about later: the floor where the bed stood, the wall behind the sofa, closet floors, the oven, under the sink.
3. Stand with your back to the window rather than facing it, because a phone aimed at bright glass turns the whole room into a silhouette.
4. Walk the place once on video, slowly, saying the date and the address out loud. Ninety seconds of footage is harder to dispute than 40 stills.
5. Lay the keys, fobs, remotes and mailbox key out together and photograph them before they leave your hand.
6. Upload all of it to your cloud account before you drive away.

That last step is the one people skip. For example, a phone that goes missing between the old place and the new one is an ordinary move-week event, and it takes the entire case with it.

## Hand the keys back so the date is not a matter of opinion

The clock runs from the day you give the unit back, which makes that date worth proving. **A key receipt** is a dated line, texted or signed, naming what you handed over and to whom. It takes one minute and it removes an entire category of argument.

- Count the items out loud as you pass them across: door keys, mail key, gate fob, garage remote, parking permit.
- Ask the manager to confirm by text or email. If they will not, send your own message stating what you returned and when, and keep it.
- If the keys go into a drop box, photograph them in the slot and message the office to say they are there.

Consider the difference this makes three weeks later. One tenant remembers handing the keys over "around the end of the month". The other has a text from the manager at 5:12pm on the 12th, with a photo of five keys on a counter.

## Damage from the move is our problem, not your deposit

A scuff a crew puts on a door frame is ours to deal with, not a line on your itemized statement. Tell us the day it happens and send the photo. Walk the rooms with the crew before loading starts as well, so any mark that was already there goes on both copies of the inventory sheet, yours and ours.

The protection arrives on the truck: door shields, floor runners, thick moving blankets, unlimited wrap and tape, and up to 8 loaner wardrobe boxes. In a building it covers more than your own belongings. Hallway walls, the lobby floor and the elevator cab stay wrapped as well, since a building bills those back to the tenant who booked the move. Our [apartment moving](https://agmovingservice.com/services/apartment-moving/) page covers buildings with a form and an elevator window.

Three habits cause most move-day marks, and all three are avoidable.

- Dragging instead of lifting. A dresser pushed across a wood floor leaves a line that no buffing takes back out.
- Forcing a wide piece through a narrow door. **Hinge pins** are the metal rods holding a door to its frame, and tapping them out lifts the door away for a couple of extra inches of clearance. Ask the crew to pull the door instead.
- Carrying loaded drawers. Empty them, take the feet off whatever unbolts, and the piece gets lighter and narrower at once. Our crews disassemble as standard, so say what is coming apart when you book.

Not every mark is a charge, either. Our post on normal wear and tear goes surface by surface, since a faded traffic lane in a carpet and a gouge in a floorboard are different conversations.

## If your landlord is not returning your security deposit in California

When a landlord is not returning your security deposit in California, the first move is a dated letter, not a lawsuit. Work through it in this order.

1. Check the mail at the forwarding address, and check your own dates. Count from the day the unit went back.
2. Read the California Courts [guide to security deposits](https://selfhelp.courts.ca.gov/guide-security-deposits-california). It explains the deadline, what a landlord may deduct, and what to do when nothing shows up.
3. Write one page: the rental address, the move-out date, the amount held, what arrived, what you want back, and the date you want it by. Send it to the owner and the management company, and keep a copy.
4. If that goes unanswered, the courts' [small claims pages](https://selfhelp.courts.ca.gov/small-claims) carry the filing limits and the procedure.
5. Get free help before you file. The [Los Angeles County small claims advisors](https://dcba.lacounty.gov/small-claims/) and the [Orange County Superior Court self-help pages](https://www.occourts.org/self-help/smallclaims) both cover this at no cost.

We are movers, not lawyers. The links above go to the people who answer deposit questions for a living, at no charge. Our part of it happened on move day, in the photographs.

## Owner-managed or office-managed: know who you are chasing

Who holds your deposit changes what chasing it looks like, and the housing stock usually tells you which one you have.

- Planned communities and large complexes around [Irvine](https://agmovingservice.com/service-areas/irvine/) and Anaheim run move-outs through an office. There is a portal, a form and an accounting cycle. Ask for the email address of the person who processes move-outs, not just the leasing desk.
- Older duplexes, fourplexes and bungalow courts in [Pasadena](https://agmovingservice.com/service-areas/pasadena/), Glendale and much of Los Angeles are often owner-managed. Your record is a text thread with one person, so keep it in writing when the conversation turns to money.
- Buildings in [Long Beach](https://agmovingservice.com/service-areas/long-beach/) and central Los Angeles frequently have an on-site manager who is not the owner. The person who takes your keys is not the person who cuts the check. Send your forwarding address to both of them.

Let's say the building changed management companies partway through your tenancy. Write to the current company, and name the one you originally paid the deposit to.

## Book the truck so the last hour belongs to you

Book the truck for the morning and the last hour of the day is yours: photographs in daylight, keys back when you said, and no scramble in the dark. When a load runs into the evening, the evidence pass is the first thing to go.

Crew size is the lever you control. Two movers and a 24-ft truck are the baseline, and a third pair of hands on a stairs job often ends the day hours earlier, with that crew choice priced into the free written estimate. Our [local moving](https://agmovingservice.com/services/local-moving/) page explains how access turns into hours, and [what a move costs](https://agmovingservice.com/moving-costs/) covers the rest of the figure. The written estimate caps the bill, so what we hear about your building at quote time is what your price is built on.

One last piece of vocabulary, because the word trips people up. There is no deposit on a standard booking with us; same-day and last-minute bookings may require one, confirmed with your quote. That is a booking deposit, and it has nothing to do with the security deposit you are chasing.

Call [(818) 391-8215](tel:+18183918215) or [send us the details](https://agmovingservice.com/contact/#quote) with the address, the floor and the date the keys go back. ## Frequently asked questions

### How long does a landlord have to return a security deposit in California?

Twenty-one days after you move out. In that window a landlord either sends the whole deposit back, or sends the balance along with an itemized statement of what was kept. The California Courts guide to security deposits explains how the deadline works and what a landlord is allowed to charge for. Read the guide rather than anybody's summary of it, including ours.

### What do I do if my security deposit never arrives?

Write a dated letter asking for it and keep a copy. Put the rental address, your move-out date, the amount held, what did or did not arrive, and the day you want the money by. Send it to the owner and to the management company named on the lease. The California Courts small claims pages set out what comes next, and every county has a free small claims advisor who will talk you through it.

### Where do I send my forwarding address before moving out?

To whoever the lease names as the landlord, and to the management company as well if there is one. Send it in writing, by text and by email, and keep the sent copies. Deposits go astray far more often because nobody knew where to post the check than because a landlord decided to keep the money.

### How long should I leave between the truck pulling away and handing back the keys?

Two hours at a minimum, and a whole afternoon if the cleaning is not finished. The empty apartment is the only version of it you can photograph, and that pass takes about twenty minutes in a one-bedroom and closer to forty in a three-bedroom. Booking the truck for the morning is what buys that time.

### Do movers take a deposit to book a move in Los Angeles?

There is no deposit on a standard booking with us. Same-day and last-minute bookings may require one, and it is confirmed with your quote either way. A booking deposit and a security deposit have nothing to do with each other, though the word does cause confusion at the worst possible moment.
